The FCC has released the Public Notice for 248 mutually exclusive LPFM applications in 79 groups. Applicants covered under this public notice were in the following states:
- Alaska
- Arizona
- California
- Colorado
- Hawaii
- Kansas
- Missouri (Kansas City ONLY)
- Nebraska
- Nevada
- Oregon
- Utah
- Washington
During the first 30 days of the window, Petitions to Deny and Informal Objections may be filed against any other applicant.
During a 90 day window starting at Midnight EDT on July 10, 2014, the FCC will waive the rules to allow for major changes by any of the applicants listed in Appendix A. Applications will be accepted first come first served. If applications are received the same day, they will take the first acceptable one and return the others.
There has been some questions and conflicting information from the FCC. One person has reported that FCC staff is stating that applications filed on the same day would be treated equally. However, Footnote 37 of the Public Notice reads:
" The Bureau will process and review the major change amendments in the order that they are filed on a daily basis. If the first-filed amendment is acceptable, the Bureau will return all subsequently-filed conflicting amendments, giving the second-filed applicant the opportunity to pursue other options, including settlements, other major amendments, and minor amendments, to remove application conflicts. All amendments filed on July 10, 2014, must be protected by any amendment filed after July 10, 2014. Amendments filed on weekends or holidays are considered to be filed the next business day. See 47 C.F.R. ยง 1.4. "
This gives us the impression that the "first-filed" amendment, if acceptable will be the one accepted and any subseqently filed amendments will be returned.
During this 90 day period, top scoring MX applicants (those who are considered tentative selectees) can file partial time share agreements and aggregate points.
The FCC has suppressed the viewing of all of the applications in CDBS.
