Today, based on Informal Objections filed by Moody Bible Institute of Chicago, licensee of first adjacent channel WKZM, Sarasota, FL and LPFM applicant Palm Harbor Radio (who was subsequently granted the same channel 30 km away and is now licensed as WZIG-LP), the FCC has dismissed the application for WKMJ Radio Live The People Station, Inc. (Facility ID 194483, BNPL-20131107AAI) to serve Pinellas Park, FL.

REC clarifies the processes and the qualifications for which we will agree to withdraw our Informal Objections against applications that were filed through the organization known at the time as Hispanic Christian Community Network headed by Antonio Cesar Guel.  

The Audio Division has dismissed 14 applications, mainly in rural Oregon that were "assisted" by Robert Lund.  These applications were the subject of objections made by Prometheus Radio Project and other parties. 

In all of the cases reviewed by REC, the FCC dismissed the applications because while the organization may have formed a corporation in time of the application filing, the corporation was no longer recognized by the state.  This is usually due to the failure for the corporation to file an annual report. 

Citing §73.853(b), the FCC states that corporations are required to remain eligible at the time of filing and "at all times thereafter".  

In Reply Comments, REC has addressed a plethora of issues raised by Venture Technologies Group and other proponents who support the retention of an analog subcarrier on 87.75 MHz by channel 6 LPTV stations upon their conversion to digital television.  These services are referred to by some in the industry as "Franken-FM".  For the purpose of fairness, we refer to them in comments as "FM6".

When Rodger Skinner wrote the petition that resulted in RM-9242, one of the petitions that became a part of the Mass Media Docket 99-25 rulemaking that eventually created the LPFM service, he envisioned that LPFM would mirror the structure of Low Power TV.  This included the ability for LPFM stations to be allowed to carry commercials.
