REC Filing Window Application Tracking System

1/27/22 04:45PM ET - MX settlement window ends on Friday, January 28, 2022. We note that while the formal window ends at that time, some groups have requested extensions from the FCC to continue their settlement negotiations. We are not privvy to which groups those are (we are involved in a couple of them but we can't disclose them for confidentiality reasons). If amendments are made after Friday, we will still note them and if there is a change in the predicted winner, we will leave notes in the MX Group Scoring Notes that states who the previous predicted winner was before the change and then the system will reflect the predicted winner based on the amendment. Remember, our predictions are just that, predictions. Predictions are based on our understanding of the scoring process as described in the Public Notices, the FCC Rules and our consultations with staff. Park Public amended both of their applications. This eliminates the conflicts between the two Park Public applications (Tofte & Virginia) but both applications remain MX with Elemental and Two Harbors. Notes on amendment suggest that Elemental will be changing to Ch. 212 to break out of group. (This has not yet been filed) Even if Elemental breaks out, they will be MX with Two Harbors that is currently the lead applicant in this group due to having bona-fide white area. These amendments do not change the outcome of the group.

Two Harbors files an amendment which includes a partial settlement agreement. Under the agreement, Elemental has agreed to move to Ch. 212 (no application has been filed yet). If Elemental changes channel and based on Park (Virginia)'s amendment, Park (Virginia) and Elemental would become singleton. There would still be mutual exclusivity between Park (Tofte) and Two Harbors. Two Harbors is still projected to win based on a bona-fide white area claim.
